Clearance AC (the "Seller") is an independent retailer of MRCOOL products and does not provide installation services. By purchasing from us, you (the "Customer") acknowledge and agree to the following terms regarding product use, installation, and liability.
2. DIY vs. Non-DIY Equipment

DIY Products: Certain MRCOOL products, such as MRCOOL DIY mini-split systems, are designed for self-installation by homeowners. These products come with manufacturer-provided instructions and support.

Non-DIY Products: Other MRCOOL products, including furnaces, central air systems, and certain heat pump units, must be installed by a licensed HVAC professional to ensure proper operation, safety, and warranty validity.
3. Customer Responsibility for Installation & Compliance
The Customer is solely responsible for ensuring that all products are installed in accordance with local codes, regulations, and manufacturer guidelines.
The Seller is not responsible for any damage, injury, or property loss resulting from improper installation, faulty wiring, or failure to follow manufacturer instructions. It is the Customer’s responsibility to ensure compliance with all applicable state, county, and municipal regulations before purchasing and installing HVAC equipment.
4. Warranty & Manufacturer Liability
All products sold are covered by MRCOOL's manufacturer warranty. The Seller does not provide additional warranties.
Warranty claims must be filed directly with MRCOOL and are subject to their terms and conditions. If a product is installed incorrectly or by an unlicensed individual (for non-DIY products), the manufacturer may void the warranty. The Seller is not responsible for warranty denials due to improper installation.
5. Limitation of Liability
To the fullest extent permitted by law, the Seller shall not be liable for:
- Any personal injury, property damage, or financial loss resulting from improper installation, misuse, or failure to follow manufacturer guidelines.
- Any installation costs, repair costs, lost profits, business disruptions, or indirect damages arising from product defects, misuse, or installation errors.
- Any claims resulting from a Customer’s failure to comply with state or local HVAC regulations.
The Seller’s liability is limited to the amount paid for the product purchased, to the fullest extent permitted by law.
6. Returns & Refunds
Customers may return unused, unopened products within 30 days of purchase, subject to a restocking fee. Installed or used equipment cannot be returned unless covered under a manufacturer warranty claim. Shipping costs for returns are the responsibility of the Customer.
Products must be returned in resalable condition, with all packaging intact. Refunds will not be issued for products that have been used, installed, or are returned after 30 days.
7. Shipping & Delivery
The Seller is not responsible for shipping delays caused by carriers, supply chain disruptions, or other factors beyond our control. While we strive to meet delivery expectations, the Seller is not liable for any delays caused by external factors. No refunds or compensation will be offered due to shipping delays outside the Seller’s control.
Customers must inspect shipments upon delivery. Any damaged or missing items must be reported within 48 hours of receipt. The Seller is not responsible for any damage that occurs after delivery, including mishandling or improper storage.
8. Indemnification Clause
By purchasing from the Seller, the Customer agrees to indemnify, defend, and hold harmless the Seller, its owners, employees, and affiliates from any claims, damages, or liabilities arising from the Customer’s use, installation, or resale of the equipment.
9. Acknowledgment & Acceptance
By purchasing from the Seller, the Customer acknowledges that they have read, understood, and agreed to these terms. The Customer assumes full responsibility for installation and compliance with applicable laws and regulations.
10. Online Store Terms
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you have given us consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction.
